    CHP FAQ says:

    Q: Can motorcycle riders "split" lanes and ride between other vehicles?

    A: Lane splitting by motorcycles is permissible but must be done in a safe and prudent manner.

    I recall from my motorcycle riding days that it's only legal if the traffic is going below 15mph and the motorcycle's speed doesn't exceed traffic's speed by 15mph (or some other such slow differential).

    But I can't find any reference to that. I'm pretty certain that's the CHP's "rule of thumb" to determine whether or not the ride is is being "safe and prudent", but that it's not actually a law.

    If you think it *is* a law, please let us know the CVC section. If it's in writing anywhere authoritative, even if it's not the CVC, please share.

    Just what I was told by a family member who

    is an LA County Sherrif...

    Told me that tidbit as part of a story about him being pulled over splitting lanes at 100+ w/ his sidearm showing because his shirt had come up.

    FYI, safety is purely a judgment call and the ticket you'd get for splitting lanes going faster than "acceptable" is a basic speed law ticket.

    I race crutch rockets all the time...who wants a wasp on your tail that will push you to a near crash. Let them pass then have their hair stand on end coz they cant shake you to 150mph. when its over give the polite sportsmanship wave...i.e thanks.
    If a situtation arises with other traffic or a squeeze be a gentleman and BACKOFF...then back on the gas. A getoff on a bike hurts. I raced motocross.
    Please the M3 already has a reputation of rich punk kids behind the wheel...lets get some respect back from the other motorists.

    CVC Sections Discussing Lane Splitting...

    California State Law doesn't absolutely say that motorcyclists may split lanes, however, there is no vehicle code section that actually prohibits it so, by default in the great state of CA, it is legal (thus why the CHP said so). These are the VC sections that apply here:

    21714 VC:
    The driver of a vehicle described in subdivision (f) of Section 27803 shall not do either of the following:

    (a) Operate the vehicle in any lane established under Section 21655.5 as an exclusive or preferential use lane for high-occupancy vehicles.

    (b) Operate the vehicle in either of the following:

    (1) The area on, or immediately adjacent to, the striping or other markers designating adjacent traffic lanes.

    (2) The area between two or more vehicles that are traveling in adjacent traffic lanes.

    27803(f) VC:
    (f) This section does not apply to a person operating, or riding as a passenger in, a fully enclosed three-wheeled motor vehicle that is not less than seven feet in length and not less than four feet in width, and has an unladen weight of 900 pounds or more, if the vehicle meets or exceeds all of the requirements of this code, the Federal Motor Vehicle Safety Standards, and the rules and regulations adopted by the United States Department of Transportation and the National Highway Traffic Safety Administration.

    27803 VC discusses the requirement for motorcycle riders to wear helmets in CA. The vehicles described in section f are exempt from the helmet law, however 21714 VC references them as being prohibited from lane splitting.

    So, three-wheeled enclosed vehicle that is 7 feet long (or more) and 4 feet wide (or more) and is more than 900 pounds is forbidden from lane splitting ("the area on, or immediately adjacent to, the striping or other markers designating adjacent traffic lanes"; "the area between two or more vehicles that are traveling in adjacent traffic lanes").

    Sorry folks, as dangerous as it seems, lane splitting by motorcycles in California is perfectly legal.
