If it's anything like the E46 M3........
there is no limiter (except redline) in the lower gears. The M3 can hit about 165 mph (true mph) at redline in 5th gear. I'm wondering what the top speed in 6th gear on the M5 is? It's probably not governed.
As was said, the speedo is about 10% high. The word from BM is they set the speedo to read right on when the tires are 1/2 worn. If that's the case, then the speedo will read low from 1/2 to worn out tires.

It's a speed limiter, not a rev limiter. The car also does have a rev limiter which kicks in at around 8,500, which is a very good idea. The engine revs up so fast it would be easy to over-rev.
The speed limiter does kick in at about 170 indicated. At that point it's in 6th and would have more to go, then of course there is 7th.
BMW stated that ungoverned the car will go 205 mph. - I believe it.
