Can you account for your whereabouts during the time period when this happened? We're going to need fingerprints, a DNA sample, and possibly body cavity searches.

The 'Street of Dreams' defense

Outside court, it had been eerily silent during the Briana Waters trial. No courthouse protests, no action in the streets, not even flyers at The Evergreen State College. Her supporters had been circumspect. Then, this morning, it was all over the news. "Street of Dreams" arson. ELF.
Waters has been on trial in Tacoma for a role in the 2001 arson at the University of Washington's Center for Urban Horticulture, attributed to Earth Liberation Front. As if scripted, her defense team — Oakland, Calif., attorney Robert Bloom and Seattle's Neil Fox — appeared in U.S. District Court by mid-morning to move for a mistrial due to the publicity of the fires this morning in Woodinville, Wash. A photo of a scratchy, red-spray-painted message was on every newspaper Web site from Bellingham to New York by 11 a.m.: "Built Green? Nope Black! McMansions & RCDs [rural cluster districts] r not green. ELF."
It would have been difficult to not know about the fires. The publicity, the attorneys asserted, would prejudice the jury, which is not sequestered. Not surprisingly, Judge Franklin Burgess denied the motion. However, it is surprising that he has not issued instructions to the jury to ignore today's events as they continue in their deliberations.
If Waters is convicted, this ruling might become an issue in her appeal. It may be a long time before we know if ELF is truly responsible and if it was a deliberate attempt to affect the outcome of the Waters trial. But it should be within days that the jury returns with its verdict.

Let us all bash the college kids for 20K worth of damage to public property. Then we will sit hushed mouthed about millions that the Bush Administration claimed is just lost and billions on a war against innocents. And at the end of the day we can call ourselves the perfect citizen. I wonder if Boeing people are going to riot next? probably not they are way too scared. 40B deal taken from them and gone to Europe company. No wonder many stores in NY are now taking Euros only.

Reports offer police side of riot

Reports released Tuesday provide a firsthand look at rioting at The Evergreen State College through the eyes of law enforcement officers who responded, addressing their use of batons and pepper spray to move rioting concertgoers and the rioters throwing objects at police and patrol cars.
Evergreen Police Chief Ed Sorger released the reports of outside police agencies about the Feb. 15 riot in an e-mail to students and staff members.
Rioters flipped and destroyed a Thurston County Sheriff's Office patrol car toward the end of the riot, after police left, and damaged three other patrol cars, causing an estimated $50,000 in damage.
All names in the 51 pages of reports released by Sorger were blacked out.
A deputy's report describes the crowd as "relatively peaceful" when the deputy arrived to assist an Evergreen officer as she attempted to arrest a concertgoer, and a crowd of 50 to 75 people "was telling her that she had arrested the wrong subject and that she needed to let him go."
"The crowd began chanting 'let him go' and '(expletive) the pigs,' as more individuals began exiting the arena." The crowd grew to about 300 people.
The deputy described being struck "by flying debris, including bottles and coins, and several individuals began pounding on the vehicle. I felt someone attempt to grab my duty weapon on my belt and had to push several people back away from us."
The deputy described the crowd growing more hostile in its language toward officers after deputies asked Olympia police to "move down to our location to assist with moving the crowd back from the vehicle. The crowd began to resist as the officers moved toward us and pepper spray was deployed."
The man who was arrested by an Evergreen officer on suspicion of fighting in the concert hall was released, "but to no avail of appeasing the crowd."
"I observed a white male, early 20s, medium height, slender build, wearing a bandana over his face, approach me with a garbage can, which he threw at me and struck me in the legs," the deputy wrote. A woman then threw a garbage can lid at him, the deputy stated.
"I was struck in the side of the head by flying rocks that were being thrown from behind me and to the side of me." As the deputy got in his vehicle, "Several subjects continued to throw things at my vehicle, further smashing my vehicle and causing several dents."
Another deputy's report described "a strong odor of intoxicants coming from the area" where a group of bystanders were. That deputy also wrote that the crowd accused police of trying to arrest the concertgoer "because he is black."
The deputy said that after police decided to release the suspect, the Evergreen officer tried to tell the crowd "but was shouted down."
Members of the crowd then started writing anarchist slogans on the Evergreen patrol car, the deputy said.
The deputy said that as officers attempted to leave, the crowd was "in full riot mode" and continued to throw "rocks, glass bottles, garbage cans, and any other debris they could find."
The deputy described a masked male hurling a metal drain cover at his patrol car, leaving a large dent.
"As I was still trying to leave, another masked male threw a cement block at me and shattered my front passenger window," he wrote.
In another supplemental report from the sheriff's office, a deputy described being hit with pepper spray and struck by items thrown by the crowd.
Olympia Police report
In a report, an officer described seeing "a large crowd of 150 to 200 people in a circle," chanting "(expletive) the police" and "let him go."
"The crowd was very dangerous, and it was becoming a life-threatening situation for the Officers in the center of the unruly crowd. ... " the officer wrote.
After the crowd starting throwing items, the officer wrote, "It was determined that we were going to leave the situation without any attempts to deal with the crowd or arrest any participants. We were greatly outnumbered, and had no choice but to retreat and regroup."
The crowd blocked police, the officer wrote, and as officers went to their patrol vehicles and attempted to exit, the crowd followed.
"Now several subjects were breaking off large tree limbs and throwing them at us like spears. ... People got on several patrol vehicle(s) with officers in them, and tried to break out windows. People grabbed several garbage cans and thew them at both Officers and patrol vehicles."
The officer wrote that he tried to keep the crowd back as officers retreated.
"We were in no way trying to advance on the crowd of people, and it was clear by our actions that we were simply trying to leave. ... I gave commands to many people that were throwing items at us, or advancing toward us to stay back. I pushed many people back with my hands. I used my issued can of OC-10 pepper spray on several people. Prior to spraying anyone I told them to get back."
Another Olympia officer's report says the crowd "resembled the crowd that we encountered during the port protests in November of 2007." He describes using his baton to push the crowd back and someone attempting to take his baton.
State Patrol report
A trooper's report described "Debris, including rocks, sticks, tree limbs, bottles and other large items" being thrown at the two patrol cars initially on the scene.
"I saw several officers struck by the debris and that protesters were throwing from point-blank distance at times. Of the approximately 200 protesters, it looked like the majority were yelling and refusing to disperse but only 20 to 30 were throwing things."
The trooper wrote that someone yelled "kill the (expletive) pigs." After police retreated, the trooper wrote, "I saw the crowd swarm around the abandoned patrol car and I heard glass breaking. I saw the car to be racked and bounced and knew they were attempting to roll it over. I could hear them cheer."
Release upsets some
Sorger said he released the reports before consulting with other police agencies.
"I wanted to get this out, without people's names, so that people can see for themselves in the officers' own handwriting their perspective on that night, and how that really was a dangerous situation for officers," he said.
Thurston County Chief Criminal Deputy James Chamberlain said Sorger called Sheriff Dan Kimball after releasing the reports to people at Evergreen.
"I don't think he should have done it without consulting us," Chamberlain said. "They weren't his documents, but it's done."
Olympia Police Lt. Jim Costa also did not think releasing Olympia's reports was appropriate.
"I think when you have documents that are released from other agencies, you kind of owe it to them to let them release the documents themselves," he said.
