New strategy for red-light camera tickets?
Recently my 18-year old niece received a red-light camera ticket. Fine was $475 + $120 for traffic school. Car is registered in her dad's name, so the ticket was issued to him.
He took the ticket down to the court and told them it wasn't him driving. Clerk says "Would you be willing to tell us who was driving?"
"Do I have to answer that question?"
"No - that's why it's worded that way."
"No, I would not be willing."
Case dismissed.
WTF???
Seems like the only reason we have lawyers anymore is to protect rapists' rights and legalize pot.

It's a matter of degrees.
Some (most?) cameras nail you if you're in the intersection anywhere when it turns red. You might have had to wait for oncoming traffic to turn left or not have been able to stop on the yellow. If a cop sees that, they let you go because they can observe the situation. The cameras don't care. Everyone gets the same fine whether you were just completing a left or you nearly caused a fatal accident. Just like speeding. Should all speeding fines be $500 regardless of speed?____________________________________________ ________________

interesting
I don't think the law in my state breaks down "running a red light" into different categories (unlike speeding). I'm pretty sure it's illegal to be in the intersection when the light turns red, under any circumstances, and quite frankly the danger seems to be very high in any event.
Also, what kind of situation leads to not having been able to stop on the yellow, other than not paying attention or driving too fast while approaching the light?

uh, doubt it (in the intersection when it turns)
as was said - if you enter an intersection to turn left, then oncoming traffic fails to yield at yellow, you will undoubtedly be in the intersection when it turns red - because it would have been unsafe to proceed.
Ah, you say - then you should not have entered the intersection in the first place. I may be wrong about your state, but most allow you to enter the intersection - it's safe, just not safe to perform the left - then complete the turn when oncoming finally stops at the signal change. Otherwise, gridlock can occur with no cars able to move in your direction because you can never turn left if oncoming is heavy.
this off of iihs.org
"A violation occurs when a motorist enters an intersection some time after the signal light has turned red. Motorists inadvertently in an intersection when the signal changes to red (waiting to turn left, for example) are not red light runners."

that's not exactly correct
the cameras here are intelligent - they know your speed:
- approaching,
- within, and
- exiting the intersection.
And they correlate all these speeds and your position to precise timing of the light (ie., when it changed from yellow to red).
All these issues are reviewed prior to the ticket being issued. They won't issue a ticket in the case of being caught in the intersection on a red (although the camera might take your picture).

They do in Chicago.
Lots of folks b*tching about it, too. I saw a guy get snapped once while waiting to make a left. No idea if he got ticketed, though.___________________________________________ _________________

Re: New strategy for red-light camera tickets?
The issue is should the ticket been wiped? Here, the ticket is accompanied by a statutory declaration form. If you do not nominate a driver, the vehicle owner wears the fine. If the owner is a company, you must nominate a driver or suffer a $1069 fine.
