That sounds like possible LCM trouble. Use
the search and maybe the guys who know more about it than me will chime in.

Could B LCM trouble as BMW540 said, be sure to (m
check the driving lights (U mean fog lamps right?) to make sure they aren't burned out. You didn't mention if you got a message in the speedo cluster saying they were bad.
I would also disconnect both battery cables, then short them together for 5 min with the key in the run position to drain all the charge from all of the modules. Let the car sit with access to the battery for 16+ min until all modules go to sleep B4 you disconnect the battery.
Is it just the 3rd brake light that flashes? Are your sure the other brake lights are not flashing too? If they are, it could be a bad brake light switch.
If you still have problems after you do the battery disconnect thing you probably do have LCM problems.

Ok, I have a 99 528iT. My LCM has been replaced. My 3rd brake light flashes on/off randomly. And I have a light out warning on my dash. All my other lights work fine.....Im also wondering, if I turn my headlight switch to the middle position, shouldnt my orange corner lights come on? Some people call them driving lights or park lights?? My orange side markers come on, but not the corner lights. My turn signals work/

Check for leaks from the sunroof..
I had some weird things like that happen a few days before i had a FIRE.
Brake lights would randomly come on and stay on sometimes. Sunroof pipe was disconnected. Water came down the pillar straight onto the LKM

I dont have any issues with my tail brake lights. Just the third brake light on the roof of the tailgate. I've had my LCM replaced with no other problems as far lights. I also had a leaking sunroof and the hose was reattached. What could this be?

Better safe than sorry
I paid the dealer so much and in the end there was still a leak, i had to figure it out myself. they just said it was a bad sunroof seal, meanwhile it was the pipes going into the sunroof cassette.
Doesn't matter which lights turning on, every single bulb in the e39 is controlled by the LKM. When it was shorting out i had every single light on the car blinking or staying on RANDOMLY.
